Silas v. Hageman died May 14, 1966. He was survived by his widow, plaintiff Ella M. Hageman, and by three children of a prior marriage. During his lifetime, decedent created a revocable inter vivos trust which provided that upon his death 40% of the trust income would be paid to the plaintiff with the remainder of the income added to the trust corpus, and that upon plaintiffs death, the corpus would be distributed equally to the three children.
