LIMITATION OF ACTIONS ? ATTORNEY AND CLIENT ? MORTGAGES ? APPEAL AND ERROR. 1. Limitation of Actions ? Application to defenses. Statutory limitations apply only to actions and not to defenses; and even though defendant, in mortgage foreclosure action, predicated both cross complaint and affirmative defense on services rendered for plaintiff, it was not error to receive, in support of affirmative defense of payment by services rendered, evidence of services rendered by defendant for plaintiff more than five years prior to filing of action, notwithstanding contention that claim for such services was outlawed by statute of limitations. 2. Attorney and Client ? Interest on attorneys fees. Interest could properly have been allowed on attorneys (counter) claim for services rendered. 3. Appeal and Error. ? Judgment, when sustained. Judgment must be sustained if supported by evidence viewed in light of any theory.
